Terms and Conditions of Service

These Terms and Conditions govern the use of the platform and services provided by KaFuKa SaaS, owned by NOVADX, SOCIEDADE UNIPESSOAL LDA (hereinafter referred to as "NOVADX"). By subscribing to our services, the Client agrees to the following conditions.

1. Services and Subscriptions KaFuKa SaaS provides cloud software solutions, hosting, and managed services. The specific details, capabilities, limits (e.g., storage, users), and SLAs of each service are described at the time of subscription. The Client acquires a non-exclusive, non-transferable right to use the services during the agreed billing period.

2. Billing, Payments, and Automatic Renewal

  • Billing Cycles: Services are billed on a recurring basis (monthly or annually), as selected at the time of purchase.
  • Payments: The Client agrees to provide a valid payment method. Invoices are automatically generated before the renewal date.
  • Non-Payment and Suspension: Failure to pay by the due date will result in automated warning notices. If the invoice remains unpaid after the grace periods defined in our system, services may be automatically suspended or terminated, resulting in data loss.

3. Client Responsibilities (Acceptable Use Policy) The Client is entirely responsible for maintaining the security of their access credentials and for all activity that occurs under their account. It is strictly prohibited to use KaFuKa SaaS to:

  • Host or transmit illegal or malicious content, or content that violates intellectual property rights.
  • Send unsolicited emails (Spam).
  • Perform activities that intentionally overload or harm our infrastructure. NOVADX reserves the right to immediately suspend any account that violates these rules.

4. Technical Support (Service Desk) Technical support is provided through our Ticket system in the Client Area and our official channels (such as integrated WhatsApp). Response times vary depending on the severity of the issue and the contracted service level. Support does not cover troubleshooting issues caused by improper interventions made by the Client.

5. Limitation of Liability NOVADX commits to making its best efforts to ensure maximum service availability (Uptime). However, we cannot be held liable for interruptions caused by force majeure, third-party network failures, or unpredictable external cyberattacks. In no event shall our financial liability for direct losses exceed the amount paid by the Client in the billing cycle in which the incident occurred. NOVADX is not liable for loss of profits, data loss, or indirect damages.

6. Cancellation and Termination The Client may cancel the renewal of their subscription at any time through the Client Area. Cancellation prevents the generation of future invoices but does not entitle the Client to a partial refund for the period already paid.

7. Jurisdiction and Applicable Law These terms are governed by and construed in accordance with Portuguese Law. Any dispute arising from the provision of these services shall be submitted to the exclusive jurisdiction of the Portuguese courts.
